(b) For purposes of this section, “occupancy” means any of the following that the owner of the property has a legal right or right to occupy exclusively, for a period of more than twenty-four hours at a time, in any single transaction: (1) A rental of the property by the owner to the tenant for the tenant's personal, family, or household living use, except for that which may be used by the owner for commercial purposes, but excluding construction, repairing and remodeling work on the property, which may be done through the use of the property and materials in the dwelling unit, provided that no person shall be liable for more than two rentals of the property during the term of the lease, and provided further, that the rent paid to the tenant for the use of the property shall not exceed one hundred dollars (100). This subdivision shall not apply to rental of the property by the owner to the tenant for the purpose of business, or for use of or occupancy of the dwelling unit for any public or private entity or institution, the payment of which is directly attributable to the occupant.
